1. INTRODUCTION

In the following terms and conditions, 'we', 'us', 'our' or 'Petjana' means Petjana by Petja Berginc Fučka.

The online shop www.petjana.si (known as the 'Petjana online shop ') is made available to you (herein known as 'the Purchaser') pursuant to the following trading terms and conditions which are legally binding.

The terms and conditions of Petjana online shop are compiled in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1).

The Petjana online shop is operated by the company Petjana izdelava nakita, Petja Berginc Fučka s.p., Goriška cesta 34, 5270 Ajdovščina, Slovenija, tax number: 96431563, company registration number: 8688168000.

Please read through these terms carefully before making any purchase from the Petjana online shop. Any purchase from the Petjana online shop will indicate your full acceptance of these terms and conditions.

These terms may be modified from time to time and your continued use of the Petjana online shop and any subsequent purchases made shall signify your agreement to be bound by any changes.

These terms and conditions are in effect from third of March 2023.

2. AVAILABILITY OF INFORMATION

Petjana undertakes to provide the purchaser with the following information before committing the contract or offer:

data on the company Petjana (name and registered office of the company, registration number),
contact details that enable users to communicate quickly and efficiently (e-mail, telephone),
the essential characteristics of the items (including after-sales services and warranties),
availability of items (each item offered on the online shop should be available within a reasonable time),
conditions of delivery of items (and method, place and deadline of delivery),
prices, which must be clearly and unambiguously set; it must be indicated whether they already include taxes and transport costs and other charges,
the method of payment and delivery or fulfillment, within the period of validity of this information,
the deadline within which it is possible to terminate the contract and the conditions for suspension (description of the rights to withdraw in accordance with Article 43.č ZVPot; in cases where the consumer is informed in accordance with Article 43.č),
an explanation of the complaint procedure, including all contact details.

3. ONLINE SHOP

The user can buy via the online shop and is accessible via the link: www.petjana.si and www.petjana.com
Written general conditions are an integral part of the contractual relationship between the bidder and the Purchaser – the purchase contract.
The user does not need to register to purchase in the online shop.
The information you find in the online shop (product descriptions, photos) is approximate. We reserve the right to make minor changes to the product description, without the obligation to inform the user.
Offer on the site both quantitatively and time-limited. Quantities are posted on the site are only informative and can change without notice.

4. PRODUCT AVAILABILITY

Petjana cannot guarantee and accepts no liability in regards to the availability of stock and the time frame involved in delivering any goods or service pursuant to the Purchaser’s order.

5. ORDER CONFIRMATION

Confirmation of your order will be sent to your e-mail address. The e-mail will reconfirm all delivery and shipping details, charges and any other relevant information.

It is the purchaser’s responsibility to ensure that all information provided is accurate. I aim to ship within 2-4 business days of orders being placed, however this may vary depending on demand, sickness or illness, or public holidays during the time of order. Please email me immediately should you need to make any changes to your order or if you require your order by a specific time.

6. ORDER CANCELLATIONS

• Cancellation by Petjana:
Petjana reserves the right to cancel any order at any time without notification.

• Cancellation by Purchaser:
I aim to ship online orders within 2-4 business days of the order being placed. Should you wish to cancel an order after payment has been accepted, please contact me immediately.

If an order is cancelled after dispatch, shipping charges will not be refunded and it will be the purchaser’s responsibility to return the parcel by trackable registered mail at their expense. Cancellations after this time will be at the sole discretion of Petjana.

Custom orders cannot be cancelled once payment has been made and the process of making has started. Custom orders are non-refundable.

7. BILLING

Transactions for purchases are made through PayPal or Stripe.

All goods remain the property of Petjana until they are paid-for in full. Please ensure you enter your contact and delivery details correctly, including your phone number, so that I can contact you if necessary.

8. CURRENCY

All product and shipping prices on the Petjana online shop are quoted and settled in Euros (EUR). Some credit card providers may charge additional fees, please contact your credit card provider or PayPal for more information. Petjana is not responsible for these fees.

9. CUSTOM TAXES

Purchases shipped to international addresses are subject to custom taxes imposed by your home country. For international orders, the prices listed do not include any overseas duties, customs or import charges which may apply depending on the home country.

Any additional international charges will be at the expense of the Purchaser and will not be covered by Petjana. The Purchaser may incur these charges at any time up to 24 months after the goods have been purchased.

If the Purchaser has refused to pay the custom charge, and the item is returned, shipping expenses will have to be paid again by the Purchaser for the package to be re-sent. Refunds are strictly not accepted on the returned package if the customer has refused to pay the customs fees imposed by their home country.

10. SHIPPING INFORMATION

Petjana ships from the Slovenia with Pošta Slovenije within 2-4 business days of cleared payment. Every parcel will have a unique tracking number assigned to it, which allows the customer to track its journey online. This tracking number is supplied in your shipping notification email.

Postal rates are liable to change due to price increases enforced by the postal company Pošta Slovenije. Petjana is not responsible for these increases.

The Purchaser is responsible for providing accurate delivery instructions and address upon placing an online order. If the nominated courier is unable to deliver the Purchaser’s order due to either incorrect information provided by the Purchaser or if there is no one to sign for and physically receive the parcel, a re-delivery fee may apply. This fee will be sent to the Purchaser via a PayPal invoice or a bank transfer for EU customers. There are no refunds if the Purchaser refutes that the package was delivered, while there is definite proof of delivery to the destination address by the courier.

Shipping within Slovenija:

• Please allow between 2-5 business days for delivery after dispatch notification.
• A tracking number will be issued in your order fulfilment via e-mail to the e-mail address you provide, which will enable you to track the progress of your parcel once it has been sent. It is the Purchasers responsibility to track their item.
• Petjana cannot accept responsibility for delays in delivery due to unforeseen circumstances such as natural disaster, severe weather warnings, holidays, strike or transport complications, or illness.

International shipping:

Please allow between 6 - 10 weeks for delivery within the EU after dispatch notification.
Please allow between 2 - 4 weeks for delivery fort he res of the world after dispatch notification.
• A tracking number will be issued in your order fulfilment via e-mail to the e-mail address you provide, which will enable you to track the progress of your parcel once it has been sent. It is the Purchasers responsibility to track their item.
• The package will require a signature on arrival. The Purchaser should make sure that there will be someone at the address provided to sign for it. The Purchaser has the option to include the business address of their workplace in the shipping option to ensure they can personally sign for their package.
• Petjana cannot accept responsibility for delays in delivery due to unforeseen circumstances such as natural disaster, severe weather warnings, holidays, customs, strike or transport complications, or illness.

•If the package has been delayed in transit or has been misdirected by the postal service, the customer is kindly requested to remain patient until its arrival to them. Refunds/replacements are not facilitated for when a package is still within the postal network or in the process of an investigation by the postal network.

11. LIABILITY

To the extent permitted by law, Petjana shall not be liable for indirect or consequential losses or expenses suffered or incurred by the Purchaser in relation to the supply of goods. Petjana's liability is limited only to the cost of supply or re-supply of goods in accordance with these terms.

I assume no responsibility, and shall not be liable for, any damages to, or viruses that may infect your computer, telecommunication equipment or other property caused by or arising from your access to or use of Petjana's online shop .

12. NO COMMERCIAL USE

The Petjana online shop is provided for your personal use only. You may not copy, distribute, transmit, display, modify, reproduce, publish, license, transfer, or sell any content, software, products, or services contained within the Petjana online shop . You may not use this site, or any of its content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own site.

13. AGREEMENT

This agreement supersedes any and all preceding agreements between the Purchaser and Petjana.

14. CUSTOMER CONDUCT

The Purchaser should conduct themselves in a polite and courteous manner when engaging in discussions with Petjana through email or by other methods of communication. Communications with Petjana will be immediately ceased if the Purchaser engages in threatening, abusive and disrespectful language. Communications via email or other methods with customers regarding custom orders are to remain private between Petjana and the customer. They should not be distributed or discussed openly online for any purposes whatsoever. Inciting slander of the Petjana brand will not be tolerated, and will be reported to the relevant authorities, and will be legally investigated.

15. PROMOTIONAL CODES

I may occasionally release promotional codes valid for a specified time. These codes are valid for use within the specified time frame only. All conditions applying to each promotional code will be specified at the time of issue. They may be redeemed online on the Petjana online shop only. They cannot be used in any independent Petjana stockists.

16. ONLINE RETURNS & REFUNDS

If an item is defective upon receipt, the Purchaser should contact Petjana immediately and provide photographic evidence of the defect. The item may need to be returned to Petjana if further inspection is required. The Purchaser is responsible for return shipping fees.

Petjana also offer returns and refunds on items that haven't been worn yet, are undamaged and without any signs of use (on the expense of the buyer). Please return the items within 14 days after purchase as after this time returns will not accepted.

For the return of non-personalized goods purchased under a distance or off-premises contract, Article 43.č of the Consumer Protection Act (ZVPot) stipulates that the consumer has the right to notify the company within 14 days of the receipt of the goods with a request to withdraw from the contract, without the need for them to state the reason for their decision.

I do not offer refunds on items bought on sale and all discounted designs. Custom-made pieces cannot be returned unless the item is damaged by my mistake.

Once I have received the returned item please allow 30 days for the refund to post to your account. The buyer is responsible for all return shipping costs. In case the item is not returned in its original condition, there might be a loss in value for which the buyer is responsible. The items must be packed in original packaging and a copy of the invoice must be attached when returning items.

For returns please email me with your order number stating why you would like to return it.

Items purchased online cannot be returned to one of Petjana independent stockists. Items purchased from one of Petjana's independent stockists must be returned to their place of purchase.

If an item is delayed in transit or assumed to be missing in transit, a case will be launched with the shipping provider. Patience is asked of the customer while the case is being investigated. Cases can take 30-60 days to be resolved. An appropriate course of action will be taken upon the resolution of the investigation. There is no refund on shipping costs.

17. PRODUCT VARIATION

As described in our product descriptions, every Petjana product is individualy handmade. This may result in variations in colour, shape and texture between pieces. We endeavour to minimise these variations, however all product images provided on the Petjana online shop should be taken as an example of the design, rather than the individual piece purchased. A handmade item does not have a machine made, uniform finish. The hand of the maker is evident in each piece to guarantee authenticity of a manual process. This is a charming inherent character of a handcrafted item and will not impact on the integrity, beauty or quality of the finished piece.

18. LINKING TO THE PETJANA ONLINE SHOP

You may link to the Petjana homepage on the condition you do so in a way that is legal. It must be fair and not intended to damage our reputation or in any way take advantage. You may not suggest any form of association or endorsement with Petjana where there is none. I reserve the right to request the removal of links to the Petjana online shop at any time.

19. THIRD PARTY LINKS

From time to time, the Petjana online shop may contain links to online shop s which are not owned, operated or controlled by me. Such links are provided solely as a convenience to you. I am not responsible for any content, materials or other information located on or accessible from any other online shop .

20. INTELLECTUAL PROPERTY

The purchaser will not use, copy or infringe on Petjana's intellectual property. This means all intellectual property rights (whether created before, on or after the date of these Terms and Conditions and whether registered or unregistered) in respect of copyright, any patents, trademarks, logos, designs, software, domain names, business or trade names, together with marketing concepts and designs, product knowledge, training systems and materials, protection of confidential information, circuit layouts, inventions, know-how, product or business concepts, details of product development, and any other identifiable result of intellectual endeavour, whether arising under statute or otherwise, and which relates to any of Petjana's products or services.

21. COPYRIGHT

All designs, content such as text, photograpsh, videos, soud, etc. are subject to copyright and are wholly owned by Petjana. No designs, content or photographic material represented on the Petjana online shop may be used without prior written consent. Petjana are all registered trademarks.

22. ERRORS, INACCURACIES AND OMISSIONS

While I make every effort to ensure the accuracy of information presented there may occasionally be mistakes, inaccurate, or incomplete information on the Petjana online shop. I make no representation as to the completeness or accuracy of information provided on the Petjana online shop.

23. JURISDICTION

This contract is made in the Republic of Slovenia
