General Terms and Conditions

The general terms and conditions of the Petjana online shop are prepared in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1).

The Petjana online shop (hereinafter also “shop”) is operated by the company Petjana izdelava nakita, Petja Berginc Fučka s.p., Goriška cesta 34, 5270 Ajdovščina, Slovenia, tax number: 96431563, which is also the provider of e-commerce services (hereinafter also the “seller” or “Petjana”).

These General Terms and Conditions determine the functioning of the Petjana online shop, the rights and obligations of users, and regulate the business relationship between Petjana and the customer.

The buyer is bound by the terms and conditions valid at the time of purchase (placing an online order). Before submitting an order, the user is clearly informed about these General Terms and Conditions, and by placing the order, confirms acceptance of them.

The entire content of the website, regardless of form (text, images, video, sound, etc.), is protected by copyright. Content may not be used beyond personal use unless expressly authorized in writing by the provider. In case of misuse, the user is materially and criminally liable.

By using the website www.petjana.si, the user accepts and agrees with all provisions of these Terms and Conditions. If you do not agree, please discontinue using the website immediately.

These Terms and Conditions should be read together with our Privacy Policy, which governs the processing of personal data.

Availability of Information

Petjana undertakes to provide the buyer with the following information before entering into a contract or placing an order:

  • details of the company (name, registered office, tax number),

  • contact details enabling quick and effective communication (e-mail, telephone),

  • essential characteristics of the products (including after-sales services and warranties),

  • product availability (items should be available within a reasonable period),

  • delivery conditions (method, place and timeframe),

  • prices, clearly and unambiguously stated, including information on taxes, transport costs and other charges,

  • methods of payment and delivery,

  • information on the right of withdrawal (in line with Article 43.č ZVPot),

  • explanation of the complaint procedure with contact details.

Online Shop

The user can purchase through the website www.petjana.si.

These General Terms and Conditions are an integral part of the contractual relationship between the seller and the buyer.

Registration is not required to purchase from the online shop.

Information in the online shop (descriptions, photos) is for reference only. We reserve the right to make minor modifications without prior notice.

The offer of products is subject to stock and time limitations. Quantities displayed are indicative and may change without notice.

Intellectual Property Rights

The provider holds all the necessary rights for trademarks and content appearing on the website. Trademarks are protected in accordance with national and international law. Publishing them online does not constitute a waiver of rights. Misuse of trademarks results in liability.

All content of the website is protected by copyright. The copyright holder is the provider of the Petjana online shop.

Orders

The purchase contract between Petjana and the buyer is concluded once Petjana sends the buyer the first electronic notification regarding the status of their order. From that moment on, all prices and conditions are binding for both parties.

The contract (i.e. first electronic order confirmation) is stored electronically on the Petjana server.

Methods of Payment

Petjana offers the following payment methods:

  • Bank transfer to the account of Petja Berginc Fučka s.p. (based on a proforma invoice, which means that the customer places an order via email (petja@petjana.si). After agreeing on the product details, the customer then receives a proforma invoice (pre-invoice). Once the payment has been made, the seller dispatches the ordered goodso ),

  • PayPal,

  • Credit card via a secure Stripe application.

For certain orders, the seller reserves the right to request payment in advance by bank transfer.

Upon receipt of payment based on the proforma invoice, the order enters the processing stage.

Invoicing

An invoice is sent to the buyer in electronic format to their email address after delivery of ordered items. The invoice details the breakdown of prices and costs. The buyer must check the correctness of the invoice immediately upon payment; later claims will not be considered.

Prices and Taxes

All prices are expressed in EUR (€). Product prices do not include VAT (22%) unless stated otherwise. Prices also exclude shipping and handling costs, which are calculated at checkout.

Delivery costs vary depending on the buyer’s shipping address. Payment through our system is secure and meets industry standards.

Special offers remain valid until stocks run out or the offer is withdrawn. The seller reserves the right to change prices without notice.

Despite best efforts to ensure accuracy, errors in price information may occur. In such cases, or if the price changes during order processing, Petjana will allow the buyer to cancel the order.

Discounts, vouchers and promotional codes are generally not cumulative, unless otherwise indicated.

Discount Codes

Discount codes provide specific benefits when shopping at the Petjana online shop and are limited in duration. Active codes may be published on the homepage, promotional messages, newsletters or other media.

If a customer cancels an order after using a discount code, they lose the right to reuse that same code.

Use of discount codes:

  • Add desired items to the cart.

  • Ensure the order value exceeds the discount value by at least €1.

  • Enter the discount code in the designated field at checkout and confirm.

  • Multiple discount codes may be entered if permitted, but no more than the number of items ordered.

  • The discount value is deducted automatically in the final order summary.

Purchase Notification Procedure

  1. Order confirmation – After an order is placed, the buyer receives an email notification. Petjana then verifies stock availability and confirms or rejects the order. Updates about delivery are sent via email. If delivery times are too long, the buyer may cancel.

  2. Order dispatch – Petjana prepares and ships the order within the agreed timeframe and notifies the buyer by email, including information about cancellation rights, delays and complaints.

If the buyer wishes to cancel the order, they must immediately contact info@petjana.com with the subject line CANCELLATION OF ORDER including order number and date. If the order has already been shipped, the buyer should refuse delivery.

Returns

Consumers may withdraw from the contract within 14 days of receiving goods without providing a reason. The consumer is responsible only for direct return shipping costs.

Returned goods must be undamaged, unworn, unwashed, clean and in their original packaging with tags attached. Consumers may test items only to the extent necessary to determine their nature and functioning.

The right of withdrawal does not apply to personalized or custom-made items.

Refunds are issued within 14 days of withdrawal using the same payment method, unless otherwise agreed.

The consumer is liable for diminished value resulting from improper handling.

Complaints and Material Defects

The provider sells products of proven quality. If the consumer discovers a defect, they must notify the seller within one month of discovery.

The consumer may request:

  • repair of the defect,

  • replacement of goods,

  • a refund.

A defect is presumed to have existed at delivery if it appears within six months.

Returned goods for defect claims must be collected by the buyer within 14 days of notification. Otherwise, the seller may store them (with daily storage costs of €1) or sell/donate them after six months.

Exclusion of Liability

The provider does not guarantee the absolute accuracy of content on the website. Users are responsible for protecting their equipment before accessing the online shop.

The provider may suspend or disable the website due to maintenance or technical issues without liability for damages.

Privacy and Personal Data

Petjana undertakes to protect the confidentiality of personal data in line with applicable legislation. Data is used only for order processing, delivery, and communication, and is not disclosed to unauthorized third parties.

Some information is collected automatically via cookies or web beacons. Disabling cookies may prevent purchases in the online shop.

Users may request access, correction or deletion of personal data and may unsubscribe from newsletters by contacting info@petjana.com.

The user is responsible for safeguarding their login information and ensuring adequate antivirus protection.

Complaints Handling

In case of complaints, customers may contact petja@petjana.si.

The seller will confirm receipt of the complaint within five working days and update the buyer within eight days. Efforts will be made to resolve disputes amicably. If not possible, disputes will be resolved before the competent court in Nova Gorica, Slovenia.
